Lawyer Marc Bellemare calls for
the withdrawal of Bill 84

Criminal lawyer Marc Bellemare sent a letter addressed to François Legault and the Minister of Justice Simon Jolin-Barrette, asking them to withdraw Bill 84, which aims to reform the compensation system for victims of 'criminal acts (IVAC).

This bill with multiple provisions, the details of which were unveiled on December 10, is one of
the most important modifications to IVAC since its implementation in 1972.


By expanding the list of victims eligible for the regime to any person recognized as a victim of crimes against the person, Minister Jolin-Barrette declared that he wanted an IVAC "much more human", he who had criticized the "rigidity" and "insensitivity" system in the past.

But now the criminal lawyer Marc Bellemare, who had already criticized the bill in the past,
attacks the proposed reform in a long letter in which he details his positions.


Quebec pleaded for the bill to allow several advances, including "the admissibility of victims outside Quebec, the inclusion of victims of all crimes against the person provided for in the Canadian Criminal Code and the abolition of the claim deadline for victims of sex crimes ”.

However, M e Bellamare believes that several of these points could have been the subject of "simple amendments".

“Bill 84 turns everything upside down and hides huge setbacks in relation to the current compensation mechanisms. In short, this is a bad bill, clearly reductive, unnecessarily complex, designed without consulting groups of victims on the ground,
organizations dedicated to their defense and lawyers specializing in the matter, ”said the lawyer. .


Marc Bellemare will be present at the Committee on Institutions on Wednesday, which will hear a host of groups and individuals on the content of the bill. "I am given ten minutes to comment on a very complex bill, of entirely new law, one hundred and ninety new legislative provisions, some of which, crucial, take more than a page", he lamented.

“It is virtually impossible for the groups and lawyers concerned to read, re-read, understand, scrutinize and properly interpret such a dense text in such a short time. This invitation to a parliamentary committee, under such conditions,
is an insult to intelligence and reflects an obvious lack of respect. "


Thus, the lawyer, who was Minister of Justice with the Liberal Party at the beginning of the Charest era, between 2003 and 2004, denounces the " bulldozer method " which would have become, according to him, the "trademark of the CAQ when
the time comes to consult the population on a bill of social significance ”.


In his letter of six pages and more than 1700 words, Marc Bellemare deplores in the same breath the "unnecessary complexity" of the bill and believes that it should "tend towards the harmonization" of IVAC with others Quebec plans.
