(Quebec) The Legault government will begin the long-awaited reform of family law by the fall. Quebec first wishes to table a bill on the aspect of filiation, to be adopted before the Holidays, and will present at a time that has still not been defined a second bill for issues relating to conjugality.
The Minister of Justice, Simon Jolin-Barrette, reiterated on Tuesday the commitment of the Coalition Avenir Québec (CAQ) to initiate this reform, demanded for years, during this mandate. "This is my next priority," he said to the study of the estimates for the Department of Justice. The next provincial elections in Quebec will be held in October 2022.
Phase one of the reform of family law, which he intends to table by the fall, must “deal with filiation, in relation to the best interests of the child, knowledge of his origins [and] surrogacy ”. Mr. Jolin-Barrette recalled that a judgment of the Superior Court rendered in January "obliges the legislator to modify its legislative corpus" by December. The minister's bill on parentage will respond to the findings of the court ruling, he said.
In a parliamentary committee on Tuesday, the official opposition critic for justice, Liberal MP Marc Tanguay, asked the government to give parliamentarians all the time they need to study the bill before December.

Secondly, Mr. Jolin-Barrette intends to table a bill on the “conjugality” aspect of the reform of family law. This follows a report submitted in 2015 by a committee chaired by M e Alain Roy - now special advisor to the Minister - whose recommendations have not been implemented to date. Family law has not been reviewed in depth since 1982.
Last February , lawyers demanded that Quebec provide better protection for de facto spouses. Mr. Jolin-Barrette said Tuesday that he wanted to table this second part of the reform before the end of this mandate. This component will deal with multiple issues such as the sharing of family patrimony in the event of separation for unmarried couples with children, among others.
“My goal […] is to ensure that all children are equal before the law. We do not want there to be a legal vacuum in terms of the protection of children, ”said the Minister of Justice. He says he wants to ensure that children born out of wedlock,
in marriage or surrogacy have the same rights in Quebec.
PQ member Véronique Hivon also asked Mr. Jolin-Barrette to ensure that the concept of domestic violence is taken into account, in the best interests of the child, in the custody orders issued following a a separation.
