Are you tired of hearing about abortion?
Hang on your toque with a brooch, as a lawsuit may soon put this hyper-controversial subject in the foreground.
INSIDE OUTSIDE
A Montrealer, Sofiane Ghazi, is accused of stabbing his wife who was nine months pregnant with a meat fork in July 2017.
Not only would he have seriously injured his wife (who had an emergency caesarean section), but he would have inflicted lethal wounds
on his child - who died a few minutes after he was born.
The trial will last five weeks and Crown Attorneys are considering bringing about forty witnesses in court, including a biologist, pathologist and doctors.
Remember that according to Canadian law, a child must have left the womb to be considered as a person.
At nine o'clock one minute and five seconds, the 9-month-old fetus is in his mother's womb? He has no legal status.
In the eyes of the law, it is not more important than a mass of cells.
At nine o'clock one minute and fifteen seconds, he came out of his mother's womb?
He has rights, is considered a person, and if ever someone kills him, that individual will be charged with murder. That's how it is in Canada.
The law makes no difference between a clump of cells, a few weeks old embryo, a four month old fetus or a nine month old fetus.
As long as you are not out of your mother's womb, you have no rights. You are nothing.
In short, if we prove that the baby died after he had left his mother's womb, Mr. Ghazi could be sentenced for murder, depending on his state of mind.
But if the defense proves that the baby died while he was in his mother's womb, he could get away with it.
THE VEIL CASE
Why is Canadian law so made?
Because if we admit that a nine-month-old fetus is a person in its own right, pro-life activists would say that abortion is a murder.
So we decided to draw the line at the birth of the child.
Recently, opponents of Andrew Scheer said that the Conservative leader made a major blunder by reopening the abortion file because
"the debate on the subject was closed in Canada."
Ah yes ?
I am sure that many Canadians feel uncomfortable with late abortions.
To abort at two months is one thing. To abort at five months, while the baby is viable, is another.
It is not because we have problems with the current law that we want to go back and prohibit women from freely disposing of their bodies.
I am sure that a mature society can discuss these ethical issues calmly.
Remember that Simone Veil herself, who fought tooth and nail to legalize abortion in France, was against late abortions.
And I'm sure she saw a nine-month-old fetus as a human being, not just a pile of cells ...
